Objectives

Analysis of the civil liability regime, in particular extra contractual civil responsibility, considering the specificities of information technology, checking the typical situations subject to civil liability. Consideration of the specifics of electronic means and modes of action of agents in relation to the common assumptions of liability, both in cases of negligent violation of duties as also in the case of liability without fault.

Syllabus

Civil liability ; distinction between contractual and non-contractual liability; assumptions of civil liability; unlawfulness and guilt; the problem of causality within the framework of computer practices; damage and the specificities of the obligation to compensate for computer practices giving rise to damage.
